权力制衡还是法律至上？
——公元前4世纪雅典陪审法庭地位分析

提 要：公元前4世纪雅典的陪审法庭在民主制中的地位得到了提高，不仅享有司法权，还享有立法审查权和官员监察权。陪审法庭地位的提高并不是权力制衡的结果，而是“法律至上”思想付诸实践的产物。

Abstract:In
the fourth century B.C., the importance of the Jury Courts
in Athenian democracy became more significant. In addition
to judicial power, the Jury Courtsstarted to have the power of reviewinglegislation and
supervising magistrates. This change was not a result of
power balance, but an outcome of the implementation of the
idea of the supremacy of law.
